If You are an officer, director, employee, consultant or agent of crazywin.ph or one of its direct or indirect subsidiaries or a supplier or vendor of the crazywin.ph, You are not permitted to register for an Account with Us or to use directly or indirectly any of the Services (each an 'Unauthorized Person'), other than in the course of Your employment as a Group employee. Similarly, relatives of Unauthorized Persons are not permitted to register with Us or to use directly or indirectly any of the Services. For these purposes, the term 'relative' shall include (but not be limited to) any of a spouse, partner, parent, child or sibling.
6.1. We reserve the right to suspend, modify, remove and/or add to any of the Services in its sole discretion with immediate effect and without notice and We will not be liable for any such action.
6.2. We forbid the use of all unfair practices when using the Services. We do this to protect Our customers and the integrity of the Services. Please read Our Unfair Advantage Policy which is incorporated in this Agreement for further details and Our Anti-Cheating Policy at section 28.4. Casino service is provided solely for entertainment purposes.
Casino service is provided "as it is". Casino is not responsible for service mismatch to Player’s purposes and/or ideas on how such a service should be provided.
Casino undertakes to correct all faults in the service as soon as possible, but does not guarantee their absence.
Casino reserves the right to carry out preventive work in its software and hardware suite with a temporary suspension of the service.

12.6 Date of receipt of money on Player's accounts outside of Casino depends exclusively on banks and payment systems, to accounts of which the funds are withdrawn.
12.7 The Casino reserves the right to transfer funds in a way different from the payment method specified by Player.
12.8 Notices for withdrawals must be made via the Website. The Casino will not accept withdrawal demands made by live chat or by electronic mail. Employees of the Casino are not permitted to bypass these instructions.
12.9 Finally, please keep in mind the Casino is not a financial institution. 13. DORMANT ACCOUNTS
13.1 An inactive (dormant) account is a Player Account which a player has not logged into or logged out of for twelve (12) consecutive months. If Your Player Account is deemed to be inactive, the Casino reserves the right to charge a monthly administrative fee of Php500 (or the current balance of Your account, if less) as long as the balance of Your account remains positive.
13.2 You authorize the Casino to charge this fee from Your Player Account on the beginning of the month following the day Your account is deemed inactive, and on the beginning of every subsequent month that Your account remains inactive. The Casino will stop deducting the fee if the account balance is zero or if the account is re-activated.
14. THIRD PARTY CONTENT
14.1. Abusive or offensive language will not be tolerated on Our chat boards, or otherwise by You on the Platforms or with Group staff. In addition, You are not entitled to make untrue and/or malicious and/or damaging comments with regard to the Group’s operation in any media or forum.
14.2. In accordance with the terms of our Third-Party Content policy, We may reject or delete any text, files, images, photos, video, sounds, or any other materials ('Third Party Content') posted by You on the Platforms which in Our sole opinion breaches the terms of these Agreements.
14.3. Any violation of this policy may result in removal of the Third-Party Content, a suspension of Your use of the Services and/ or such other action as may be reasonably required by Us to ensure compliance.
15. DISCLOSURE OF ACCOUNT NAME AND PASSWORD
The Account (under your registered mobile number) and password selected when You apply for membership should not be disclosed to any third party. You are solely responsible for the security of Your Account name and password.
You agree to keep Your Account (under your registered mobile number) and password secret and confidential and not to allow anyone else to use it. Every person who identifies themselves by entering a correct mobile number and password is assumed by Us to be the rightful Account holder and all transactions where the username and password have been entered correctly will be regarded as valid. Thus, a 2-Factor Authentication is required to successfully login to Your Account. In no event will we be liable for any loss You suffer as a result of any unauthorized use or misuse of Your login details. We shall not be required to maintain Account names or passwords. If You have lost Your Account username (under your registered mobile number) or password, please contact Us for to update your account information. If You misplace, forget, or lose Your Account username (under your registered mobile number) or password as a result of anything other than Our error, we shall not be liable. If you also chose to have your account auto login from your computer, it will be your responsibility to make sure that you are the only one who can access your personal computer, which a 2-Factor Authentication is mandatory to be able to login successfully. In the event that your mobile (number) got stolen, you can contact Us to reset your password and have your Account changed or updated to your new registered mobile number once request has been validated.
16. FRAUDULENT ACTIVITIES AND PROHIBITED TRANSACTIONS
The Company has a strict anti-fraud policy and utilizes various anti-fraud tools and techniques. If the player is suspected of fraudulent actions including, but not limited to:
16.2.1 We have a zero-tolerance policy towards inappropriate play and fraudulent activity. If, in our sole determination, You are found to have cheated or attempted to defraud Us and/ or the Group or any other user of any of the Services in any way, including but not limited to game manipulation or payment fraud, or manipulation of the electronic payment facilities, or if We suspect You of fraudulent payment, including use of stolen bank/payment accounts, or any other fraudulent activity (including but not limited to any chargeback or other reversal of a payment) or prohibited transaction (including but not limited to money laundering), We reserve the right to suspend and/or close Your Account and to share this information (together with Your identity) with the police, regulatory authorities and other online gaming sites, banks, payment companies, and other such appropriate agencies. 16.20 We reserve the right to make a phone call to the number provided in your user account, which at our own discretion can be a necessary part of the KYC procedure. Withdrawals may be terminated until the account is fully verified. We will make reasonable efforts trying to contact you regarding the withdrawal of the funds, but if we are not able to reach you (by email or phone) in two (2) weeks as from the date of the request for withdrawal, account will be locked, since you have failed to pass the KYC procedure.

17. ERRORS
You must inform Us as soon as You become aware of any errors with respect to Your Account or any calculations with respect to any bet or wager You have placed or any currency conversion. In the event of such error or any system failure or game error (a divergence from the normal functioning of the game logic for whatever reason) that results in an error in any odds calculation, charges, fees, rake, bonuses or payout, or any currency conversion as applicable, ('Error') We will seek to place all parties directly affected by such Error in the position they were in before the Error occurred. We reserve the right to declare null and void any wagers or bets that were the subject of such Error and to take any money from Your Account relating to the relevant bets or wagers, if there are insufficient funds in Your Account, We may demand that You pay Us the relevant outstanding amount relating to these bets or wagers. 18. SECURITY REVIEW
To maintain a high level of security and integrity in the system, We reserve the right to conduct a security review at any time to validate Your identity, age, the registration data provided by You, to verify Your use of the Services, including but not limited to Your compliance with these Agreements and the policies of the Group and Your financial transactions carried out via the Services for potential breach of these Agreements and of applicable law (a 'Security Review'). As such You authorize Us and Our agents to make any inquiries of You and for Us to use and disclose to any third party, We consider necessary to validate the information You provide to Us or should provide to Us in accordance with these Agreements, including but not limited to, ordering a credit report and/or otherwise verifying the information against third party databases. In addition, to facilitate these Security Reviews, You agree to provide such information or documentation as We, in Our unfettered discretion, may request.
19. FORFEITURE & ACCOUNT CLOSURE
19.1. WE RESERVE THE RIGHT, IN OUR UNFETTERED DISCRETION AND IN RELATION TO YOUR ACCOUNT, ANY RELATED ESP (as that term is defined at clause 8) ACCOUNT, ANY ACCOUNTS YOU MAY HAVE WITH OTHER SITES AND/OR CASINOS AND/OR SERVICES OWNED OR OPERATED BY OR ON BEHALF OF THE GROUP AND, IN THE CASE OF YOUR USE OF THE GAMING SERVICES, ANY SERVICES THAT SHARE THE SHARED GAME/TABLE PLATFORM, TO TERMINATE THESE AGREEMENTS, WITHHOLD YOUR ACCOUNT BALANCE, SUSPEND YOUR ACCOUNT, AND RECOVER FROM SUCH ACCOUNT THE AMOUNT OF ANY AFFECTED PAY-OUTS, BONUSES AND WINNINGS IF:
20. TERMINATION
20.1. You are entitled to close Your Account and terminate these Agreements at anytime to Us by withdrawing the entire balance from Your account and informing our 24/7 Chat Support specified under Contact Us. We will respond within a reasonable time provided that You continue to assume responsibility for all activity on Your Account until such closure has been affected by Us.
When You request closure of Your Account we will return any outstanding balance in Your Account to You, using the same method of payment which You provided upon registration of Your Account, or such other accepted updated payment methods with which You have provided to us subsequently, except where we are withholding such monies pursuant to “FRAUDULENT ACTIVITIES AND PROHIBITED TRANSACTIONS” or Breach of the Terms & Condition of these General Terms and Conditions.

20.3 Without limitation to section 17, We are entitled to terminate these Agreements on seven (7) days’ notice (or attempted notice) to You at your registered mobile number You have provided to Us. In the event of termination by Us, Group shall give notice of the termination to You via SMS and call and, other than where termination is pursuant to section 17, as soon as reasonably practicable refund the balance of Your Account. Where We have terminated pursuant to section 17, any payouts, bonuses and winnings in Your Account are non-refundable and deemed forfeited.
20.4. Termination of these Agreements will not affect any outstanding wagers or bets, PROVIDED that any outstanding wagers or bets are valid and are not in breach of these Agreements in any way.
20.5. The following Sections of these Terms and Conditions shall survive any termination of these Agreements by either party: 14, 17, 18, 19, 21, 22, 23, 24 and 25, along with any other Sections which are required for the purposes of interpretation.
20.6 Where You have closed Your Account, we may in certain circumstances be able to re-open Your Account with the same account details as before if You request us to do so. In such circumstances, while Your Account will have the same account details as before, it will be subject to the Terms & Condition which are in force at the date of any such re-opening; and any prior entitlements (including, but without limitation, to bonuses or contingent winnings) will no longer be valid.
21. COMPENSATION & NON-TRANSFERABILITY

21.1 You can not assign, pledge or transfer ownership under any title whatsoever to claims arising from these Terms and Conditions, the use of the Website or participation in the Games against the Casino without consent of the Casino.
20. REFUND POLICY
21.1 A refund request will only be considered if it is requested within the first twenty-four (24) hours of the alleged transaction, or within thirty (30) calendar days if a Player alleges that another individual has accessed his/her Player Account. Each refund request should be a matter of the anti-fraud check and can be processed only in case of the positive conclusion of the anti-fraud department.

23.2. WE WILL PROVIDE THE SERVICES WITH REASONABLE SKILL AND CARE AND SUBSTANTIALLY AS DESCRIBED IN THE AGREEMENTS. WE DO NOT MAKE ANY OTHER PROMISES OR WARRANTIES ABOUT THE SERVICES.
23.3. OUR MAXIMUM LIABILITY TO YOU OR ANY THIRD PARTY ARISING OUT OF THESE AGREEMENTS OR YOUR USE OF THE SERVICES OR THE COMPUTER PROGRAMS RELATING TO THE SERVICES WE MAKE AVAILABLE FROM THE PLATFORMS, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL BE LIMITED IN ANY TWELVE (12) MONTH PERIOD TO THE AMOUNT, IF ANY, YOU HAVE PAID FROM YOUR ACCOUNT IN BETS, RAKES AND/OR FEES, AS APPLICABLE, IN THE SAME TWELVE (12) MONTH PERIOD AND IN RELATION TO THE SERVICE RELEVANT TO WHICH THE LIABILITY IN QUESTION HAS ARISEN.
23.4. 23.5. NOTHING IN THESE AGREEMENTS WILL OPERATE SO AS TO EXCLUDE ANY LIABILITY WE MAY HAVE IN RESPECT OF EITHER FRAUD, OR DEATH, OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.
24. NOTICES/COMPLAINTS
If You have any complaints, claims or disputes with regard to any outcome regarding the Services or any other activity, You must submit Your complaint to Us in writing as soon as is reasonably practicable following the date of the original transaction to which the claim or dispute refers. 27. ASSIGNMENT
We reserve the right to transfer, assign, sublicense or pledge these Agreements, in whole or in part, to any person (but without Your consent) without notice, provided that any such assignment will be on the same terms or terms that are no less advantageous to You. You may not assign, sublicense or otherwise transfer in any manner whatsoever any of Your rights or obligations under these Agreements.
28. THIRD PARTY RIGHTS
28.1 Except insofar as these Agreements expressly provide that a third party may in their own right enforce a term of these Agreements, a person who is not a party to these Agreements has no right under national law or statute to rely upon or enforce any term of these Agreements but this does not affect any right or remedy of a third party which exists or is available other than under national law.
29. ENTIRE AGREEMENT, MODIFICATION AND AMENDMENTS
You fully understand and agree to be bound by these Agreements and as modified and/or amended by Us from time to time. We may amend these Agreements at any time either SMS messaging You notification of the new terms and/or by publishing the modified Agreement(s) on the relevant page of the Platforms or any place through which You access the Services. Any such modification will take effect within thirty (30) days of publication. If any modification is unacceptable to You, Your only recourse is to terminate these Agreements. Unfair Advantage Policy
The Casino is committed to taking all reasonable measures, and to do so immediately, to prevent anything that either diminishes the fun you have playing on the site, or that gives another player an unfair advantage over you when you play against them.
Unfair practices are any practice (including but not limited to the use of BOTs, AI, multiple account use and/or practices conducted in collaboration with other players) carried out by one or more players, with one or more accounts which could put any other player not engaging in such activity at a competitive disadvantage where the unfairness in such activity is due to its success being based to some extent on concealment and/or deception against such players. One way of thinking about this is to consider whether a group of peers, when presented with information about the practice, would overwhelmingly consider that practice to be unfair.
Examples of practices the Casino deem to be unfair (please note, this list is not exhaustive but simply illustrative of the types of practices the Casino will always consider unfair):
One person having multiple accounts, whether in the player’s name or another name, for the sole purpose of playing both accounts at the same time, whether at the same or different tables. In any event, it is not permitted to have more than one account under our Terms and Conditions.
2. Collusion:
Two or more players sharing and using their combined knowledge to gain an advantage over other players at a table.
3. Rating Manipulation:
Players intentionally losing games on low stakes tables to keep their rank at a lower level than it would otherwise be.
4. The Use of "BOTS":
Certain companies offer for sale programs ("BOTS") specifically created to play a game in place of an actual (human) player, and conceal its use from the other players, and avoid detection by the online gaming site. These programs are marketed by explicitly promising the prospective purchaser-user an unfair advantage over other online players not using that program.
Do we forbid/discourage all online programs?
No, definitely not. Our own website provides programs for playing online. Our objective, however, is in providing and promoting a level playing-field and the best possible user-experience for all of our Players.
How do you distinguish between Forbidden and Permitted categories of programs? Isn't it true that many of these programs are for training & e.g., improving gaming skills?

Nevertheless, what our customers want will always remain the primary influence on what we do about this. And it's there that we direct our efforts. But our customers will always have the last word about what it is they want to play and against whom. Granted some of the companies who make programs that the Casino deem "forbidden" (i.e., that satisfies the criteria above) claim that the purpose of their programs is not to assist a player to cheat an online game but rather as a training aid (even though they might concede that an unscrupulous user could indeed use it for the purpose of cheating). Think for a moment about this claim. What other plausible reason is there to make and sell programs promised to give you an unfair advantage and at the same time remain concealed from the other players and the online room, and actually take the place of a player at the online table but in a way undetectable by anyone else. That aside, emphasizing one attribute to advertise their programs ("to cheat") but disavowing that attribute entirely in every other instance is dishonest, to say the least, and certainly does nothing to help the image of our industry.
So, if these companies who make such claims were honest, they would disable the functionality that allows use of the program to be concealed — since doing so would not compromise its claimed value.
What counter-measures are we talking to prevent the use of BOTS?
Our efforts can be divided into three separate categories: (i) identification & detection; (ii) warning/suspending offending users; and (iii) additional measures through enlarged customer choice.
Identification and detection counter-measures are in place now and have been for some time. These efforts will continue to improve — so that we're able to more precisely detect existing BOTS, but more importantly so that as new BOTS are created/released, we can also prevent those from eroding the experience when on the website.
Do the efforts involve "data mining" or other intrusive means to access/read files on my computer as part of these efforts?
Yes, and indeed we want you to know that we do this and what particular data we're looking for and also why we need to. Perhaps the best way to explain this is by contrast to the most well-known form of data mining i.e., what Google, Yahoo, AOL, and others like them are doing gathering data about the user for (among other reasons) purely commercial purposes (i.e., to sell a user profile to online advertisers). Now consider what we do. Our automated software reports on any processes or programs running on your computer that have been identified as prohibited software falling within our policy. We do not scan your hard drive or take screenshots from your machine. The very limited data that is provided to us is used only to query players' computers while they're playing at our tables, solely for the purpose of detecting use of the offending type of software we're talking about here. This type of monitoring remains one of the key counter-measures against the abuses caused by BOTS, which we believe are against the interests of our players. Consequences of Unfair Practices:
Where we in our absolute discretion determine an unfair practice has taken place (whether an advantage has been gained or not), the person or persons responsible for that practice will face one or all of the following consequences:
30.5. Software
crazywin.ph platforms are used to provide the Gaming Services (the 'Software') online for your own personal use in using the Gaming Services in accordance with these Agreements, and further, that such access is made through web access online via computer or other device of which You are the primary user. The Software's structure, organization, and code are the valuable trade secrets of the crazywin.ph and/or its associated companies and/or its licensors. You obtain no rights to the Software except to use it in accordance with these Agreements. Save as expressly permitted by law, You are strictly prohibited from, and agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software or any part of it or to create, publish or distribute derivative works from the Software. You agree that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by any applicable laws, restrictions or regulations.
30.6. Shared Games, Table and Database Platform
We reserve the right, but are not obliged, to run and utilize a shared table, server and database platform or system ('Shared Game/Table Platform') which enables Gaming Service users to play with players coming into the games, tables and tournaments from other websites and brands operating on the same Shared Game/Table Platform. If a Shared Game/Table Platform is used, You agree that You may be pooled into these common game/tables, at our sole discretion, and that to the extent that You breach the terms and conditions of one site or brand that operates on the Shared Game/Table Platform, We may have You blocked, in part or full, from the entire system so that You may not play through any site or brand using or on the Shared Game/Table Platform. Without limitation to the restriction on having multiple Accounts with Us (please see Section 4), We may require that You only have one account on the Shared Game/Table Platform if the same is used.
30.7. Play Money and Real Money Account Funding
'Play money' funds have no value and are kept separate from 'real money' funds. They are not transferable to a 'real money' account nor are they redeemable for any currency. We do not promise to accurately record the number of play money chips held by You and Your play money chips may be lost at any time. Further, We reserve the right to set a maximum chip limit for play money Accounts.
30.8. Settlement of In-Game Disputes
You fully accept and agree that random number generator ('RNG') software will determine the shuffling and dealing of cards and other randomly generated events required in the Gaming Services. If there is a discrepancy between the result showing on the Software (website) and Our server, the result showing on Our server shall govern the result. 31. Membership of our VIP Loyalty Program
We may offer, withdraw, revoke and/ or amend the terms of any membership of Our VIP Loyalty Program at any time. For the avoidance of doubt, membership of Our VIP Loyalty Program is at Our sole discretion and Your status as a member of our VIP Loyalty Program may be altered by Us at any time.
